1. General Information

This website www.lapavoncella-sardegna.it (hereinafter “the Website”) is owned by La Pavoncella, a tourist apartment located in Loc. Baia delle Mimose, Badesi, SS, Italy, managed by Simone Paradiso, Tax Code [PRDSMN84L06A859H] (hereinafter “the Manager”).
Access to and use of the Website implies full acceptance of these Terms and Conditions, which govern the use, booking, and stay at the property.


2. Object of the Service

The Website allows users (“Clients” or “Guests”) to consult information regarding La Pavoncella, check availability, and make bookings for short-term stays, under the tourist rental formula pursuant to Article 1571 et seq. of the Italian Civil Code and current legislation on tourist rentals.


3. Booking Procedure

Bookings can be made directly through the Website by selecting the desired stay dates and completing the payment process. The minimum stay is 5 nights.

The booking is considered received and accepted upon payment.
This commitment becomes definitively valid only after written confirmation sent by the Manager via email, within 24 hours of payment.

The Manager reserves the right not to accept the booking, even after receiving payment, notifying the guest in writing via email within 24 hours of payment, and simultaneously refunding the full amount paid.


4. Payments

Payment can be made using:

  • Credit or debit card (Visa, Mastercard, Maestro);

  • PayPal;

  • Other payment methods indicated on the Website.

All payments are processed through secure third-party payment platforms. The Manager does not collect, store, or process payment card data directly and cannot be held responsible for any issues related to payment.


5. Prices and Taxes

Prices listed on the Website are in euros (€) and include cleaning and utility costs unless otherwise specified. These prices may differ from those on other online platforms (such as Booking, Airbnb, VRBO, etc.) as these may be subject to variations beyond the Manager’s control. Any price difference does not entitle the guest to a refund.

The cost paid by the Guest at the time of booking does not include additional paid extras, optional services, or other ancillary costs, as specified in the “Apartment” section of the Website.


6. Cancellations and Refunds

Unless otherwise specified at the time of booking, the applied rate is non-refundable, and therefore no cancellation period or withdrawal right is provided.

In case of impediments or problems of any kind, the Guest is invited to contact the property using the contact details available on the Website. The Manager will evaluate, at their sole discretion, the possible refund methods and timing on a case-by-case basis, without this constituting an obligation or established practice.


7. Check-in and Check-out

  • Check-in: from 16:00

  • Check-out: by 10:00

Any changes to these times must be agreed upon in advance with the Manager.

In accordance with current Italian law, all guests must provide a copy of a valid identity document at the time of booking confirmation and before check-in.
Failure to provide or present documents will prevent check-in and result in the loss of the right to stay and any refund.


8. Guest Responsibilities

By confirming the booking, the Guest agrees to use the apartment diligently and respectfully and to comply with the rules listed in the “Apartment – Apartment and Residence Rules” section on the Website.

The Guest is liable for any damage caused to the property, furnishings, or common areas and will be required to compensate for damages as assessed by the Manager.


9. Limitations of Liability

The Manager cannot be held responsible for:

  • Temporary interruptions of online booking services or the internet;

  • Force majeure events, natural events, or circumstances beyond their control;

  • Theft, loss, or damage to personal belongings inside the property or common areas;

  • Any damages of any kind occurring to guests during the stay;

  • Any damages the guest may cause, even unintentionally, to third parties during the stay.


10. Personal Data Processing

Personal data provided by users will be processed in full compliance with EU Regulation 2016/679 (GDPR) and applicable national laws.

11. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Italian law.
For any dispute regarding the validity, interpretation, or execution of these terms, the Court of Biella will have exclusive jurisdiction.
